Terms of Service

1. About these terms

These terms govern the websites that Common Good Digital ("we", "us") builds and hosts for UK charities ("you", "the charity"). They sit alongside the written summary in your project kick-off email, which together form our agreement. If anything in this page conflicts with what we agreed in writing for your specific project, the project-specific agreement wins.

2. What's included

  • Design and build of your new website, configured for your charity.
  • Hosting, SSL, backups, security patching and uptime monitoring.
  • Accessibility built to WCAG 2.2 AA as standard.
  • Reasonable ongoing support and small content updates as part of your subscription.

Bespoke development, integrations with paid third-party services, or significant new sections outside the original scope may be quoted separately before we start the work.

3. Fees and payment

There is no upfront build fee. You pay a monthly subscription, agreed in writing before we start, which covers hosting, support and continued ownership of the site. Subscriptions are invoiced monthly in advance by Direct Debit or bank transfer.

If a payment is more than 30 days overdue we may suspend support and updates until the account is brought up to date. We will always contact you before doing this.

4. Cancellation and exit

You can cancel at any time by giving 30 days' notice in writing (email is fine). At the end of the notice period:

  • We will hand over your domain name to a registrar of your choice.
  • We will provide an export of your content (text and images) and, where reasonably possible, a static archive of the site.
  • We will stop hosting the site and delete it from our systems within 30 days of departure.

There are no exit fees and no contract lock-in beyond the 30-day notice period.

5. Ownership

You own your domain, your content (words, images, video) and your brand. We own the underlying shared platform, design system and codebase that the site is built on, and grant you a licence to use them for as long as you are a subscribing client. We may use anonymised, aggregated information about site performance to improve the platform for all charities we work with.

6. Your responsibilities

  • Make sure the content you ask us to publish is accurate, lawful, and that you have the right to use any words, images or video.
  • Keep your charity registration and contact details with us up to date.
  • Tell us promptly about any security incident or suspected misuse of the site.

7. Data protection

When we process personal data on your behalf — for example, donor enquiries submitted through a form on your site — we act as your data processor under UK GDPR and the Data Protection Act 2018. A separate Data Processing Agreement applies and forms part of our contract with you. How we handle data submitted to this site is set out in our Privacy Notice.

8. Uptime and support

We aim for 99.9% uptime, monitored continuously. Support requests are answered during UK business hours (Monday to Friday, 9am–5pm). Urgent issues — the site being offline, broken donations, or a security incident — are treated as priority and acted on outside hours where we reasonably can.

9. Liability

We don't exclude or limit our liability where it would be unlawful to do so — including for death or personal injury caused by negligence, or for fraud. Subject to that, our total liability to you in any 12-month period is limited to the fees you have paid us in that period. We are not liable for indirect or consequential losses (such as lost donations or reputational damage).

10. Changes to these terms

We may update these terms from time to time. If the change is material we will let you know by email at least 30 days before it takes effect, giving you time to cancel under section 4 if you do not want to accept the change.

11. Governing law

These terms are governed by the laws of England and Wales, and any dispute will be heard in the courts of England and Wales.
